General Terms and Conditions (GTC) – Holyrent

1. Publisher information
Holygest SA, a public limited company registered with the Commercial Register of the Canton of Valais, with its registered office at Chemin des Ecoliers 20, 3960 Loc, Switzerland, publishes and operates the Holyrent platform, a vehicle rental management application exclusively intended for professionals.
2. Purpose
These General Terms and Conditions (GTC) define the contractual conditions under which Holygest SA provides its professional clients with access to the Holyrent services.
3. Access to the service
Access to Holyrent is reserved for professionals holding a valid license. Each Client is responsible for managing its users and their access rights. The application is available on iOS, Android and Web.
4. Description of services
Holyrent notably enables:
- Vehicle fleet management
- Rental planning and tracking
- Generation of contracts and documents
- Management of images, signatures and evidences
- User and role management
- Maintenance and support tracking
5. Subscription and duration
The service is offered exclusively as an annual subscription, automatically renewed at each expiry date. Any termination must be notified in writing at least sixty (60) days before the renewal date, failing which the subscription will be renewed for a new annual period.
Holygest SA reserves the right to suspend or terminate any account in the event of non-compliance with these General Terms and Conditions or abusive use of the service.
6. Prices and payments
Prices are expressed in Swiss francs (CHF), excluding taxes. For the first subscription year, full payment of the license is due no later than thirty (30) days after license activation. Access to the service may be terminated in the event of non-payment.
For subsequent years, full payment of the annual license is due no later than the renewal date. In the event of late payment, Holygest SA reserves the right to immediately suspend access to the service, apply late payment interest of 5% per year, and charge reminder fees. Access will be restored only after full settlement of all outstanding amounts.
7. Client obligations
The Client undertakes in particular to:
- Provide accurate and up-to-date information
- Use the application lawfully and in accordance with its intended purpose
- Respect Holygest SA’s intellectual property rights
- Manage its users, access rights and credentials responsibly
- Maintain a technical environment compatible with the Service
8. Intellectual property
The source code, brand, interfaces, database and all elements composing the Holyrent platform are the exclusive property of Holygest SA. Any unauthorized reproduction, distribution or exploitation is strictly prohibited.
9. Data, confidentiality and security
9.1 Data ownership
The data entered and generated within the application remain the exclusive property of the Client. Holygest SA acts as a data processor within the meaning of applicable data protection regulations (GDPR).
9.2 Hosting and security
Data are hosted on Google Firebase infrastructure (Europe), benefiting from encryption mechanisms, secure authentication, company-level isolation and HTTPS data transfers.
9.3 Limited liability
Holygest SA cannot be held liable in the event of hacking, loss or theft of data, provided that security measures compliant with industry standards have been implemented. The Client remains responsible for the use of its access credentials, user management and data backups.
10. Compatibility, updates and technical environment
The Holyrent Service is developed, tested and optimized to operate on recent devices running operating system versions officially supported by their publishers (Apple iOS and Google Android), and requires a stable Internet connection.
The Client acknowledges that the proper functioning of the Service depends in particular on:
- the compatibility of its hardware and technical environment;
- regular updates of the operating system used;
- installation of Holyrent application updates;
- availability of a functional and sufficiently stable Internet connection.
Holygest SA does not guarantee the operation of the Service in the following cases:
- use on obsolete, modified or unsupported devices;
- outdated or altered operating systems;
- missing, unstable, insufficient or interrupted Internet connection.
Certain features, improvements, fixes or security measures may require the installation of a newer version of the Application. In the absence of updates by the Client, or without an adequate Internet connection, access to all or part of the Service may be limited or unavailable, without Holygest SA incurring any liability.
11. Privacy policy and GDPR
Holygest SA undertakes never to sell data, to limit access to authorized persons only, to comply with GDPR requirements, and to allow data export or deletion upon Client request.
12. Maintenance and support
Holygest SA reserves the right to carry out scheduled or corrective maintenance operations to ensure the security, stability and evolution of the Service. Support is available at info@holygest.ch.
13. Liability – Limitation
Holygest SA’s liability is excluded in the event of:
- improper use of the application;
- non-compliance with technical requirements or Client obligations;
- force majeure (failures, network outages, natural disasters);
- use or failure of third-party services;
- failures, delays or interruptions related to the Client’s or its users’ Internet connection.
In any event, Holygest SA’s liability is strictly limited to the amount actually paid by the Client during the six (6) months preceding the event giving rise to liability.
14. Termination – Suspension
The Client may terminate its subscription in accordance with the conditions set out in Article 5. Holygest SA reserves the right to suspend or terminate an account in the event of non-payment, contractual breach or abusive use of the Service.
15. Reversibility
The Client may request a data export at any time. The processing time is ten (10) business days from the request.
16. Applicable law and jurisdiction
These GTC are governed by Swiss law. Exclusive jurisdiction is assigned to the courts of 3960 Loc (Municipality of Crans-Montana).
